About The Course

This virtual workshop is specially designed for the insurance industry with engineering experts and worked examples to make the learning more effective. It has been organized to provide participants a hands-on understanding in dealing with tunnel construction and foundation engineering risks.

The course leader is a regionally acclaimed Engineering Insurance Professional who has extensive experience in handling project risks in Malaysia, Singapore and in the region. He will lead the two day program sharing his knowledge and experience with a few engineering industry experts using various technical terms, examples and then relate it to the policy which will be very relevant and appropriate. The course will also address the Construction All Risks policy coverage, highlights the issues encountered in handling foundation risks and claims aspects.

Day One - An over view of current and upcoming tunnelling projects in Malaysia and the region. Some of the ongoing major foundation related project development will be highlighted. The engineering experts (guest speakers) will share their subjects while the Course Leader will attempt to guide the participants in dealing with the technical challenges of the policy. Accordingly, a brief review of the coverage afforded under the CAR (Section I) policy will be addressed. Some engineering principles will be reviewed together with the relevant policy clauses and endorsements.

Day Two – A review of construction liability issues, a few challenging case studies will be delved under this segment. The coverage of the Section II - Third party liability section will also be covered. The application of the various legal liability situations will be discussed with the aim of understanding the practical issues arising out of third party issues. Typical policy exclusions and treatment of quantum as applied will also be explored. One expert on Contracts will share a few key issues on Letter of Award and Bills of Quantities.

Learning Outcomes

By the end of the entire programme, participants will be able to:

  • Understandthe practical aspects of the Construction All Risks policy coverage and its application in relation to tunnel and foundation engineering.
  • Learn how to manage such sub-structure engineering risks effectively.
  • Describethe practical challenges and concerns that Insurers, Brokers and other stake-holders need to consider and focus on when managing these risks.
  • Highlight how engineering consultants and quantity surveyors deal with project planning and design.
  • Appreciate a better understanding of quantum calculation of material damage and liability claims.

Day 1

  • Brief introduction on Construction All Risks Policy and sub-structure works
    • Recent developments & sub-structure projects in Malaysia and the region.
    • The common foundation and tunnel construction issues.
    • Soil Investigation and Risk Mitigation for Geotechnical Structures (Guest Speaker).
    • The critical underwriting issues that warrant consideration depending on the nature of risk and hazard identification.
    • The clauses and warranties that are commonly incorporated in the policies and their impact on coverage.
    • Some consideration on Tunneling Clause and Piling Endorsement in relation to sub-structure works.
  • Material Damage (Section I)
    • Working with the ground - an engineer’s take ( Guest speaker)
    • Brief review of the CAR policy – Section I Material damage coverage;
    • Operative clause, Conditions and Exclusions
    • Discussion of complex issues and application of key concepts followed by interactive Question & Answer session

Day 2

  • Third Party Liability (Section II)
    • A presentation on the Procurement methods for tunneling and substructure works (by Guest speaker)
    • Review of CAR Policy Section II – Third Party Liability coverage;
    • General principles, insuring clause and what triggers a claim, who is covered, who is identified as the Insured, protected by the policy
    • Additional covers, Exclusions, Extensions and Special Conditions
    • Practical examples in relation to the Vibration, Removal and Weakening of Support clause (V.R.W.S) arising from deep excavation work.
